How long does an uncontested divorce take in Edmonton?
While every case is unique, a “Desk Order Divorce” (uncontested) typically takes 3 to 6 months to be finalized by the Alberta Court of King’s Bench once the papers are filed. This is significantly faster than a contested divorce, which can drag on for years in the Edmonton law courts.
Do we actually have to go to court?
No. One of the greatest benefits of an uncontested divorce in Alberta is that it is handled “on the desk” of a justice. Your lawyer prepares and files the paperwork, and a judge reviews and signs the Divorce Judgment in their chambers. You will not have to stand before a judge or enter a courtroom.
What are the residency requirements for getting a divorce in Alberta?
To file for divorce in Edmonton, at least one spouse must have been a resident of Alberta for at least one full year immediately preceding the application.
How much does an uncontested divorce cost?
At One Family Law, we believe in radical transparency. While traditional litigation can cost tens of thousands of dollars, our uncontested services are offered at a flat-fee rate. This includes the $330 mandatory Alberta court filing fee, so you know exactly what your investment is from day one.
We have children. Can we still do an uncontested divorce?
Absolutely. In fact, it is often the best choice for families. However, the court will grant the divorce only if it is satisfied that “reasonable arrangements” have been made for child support under the Federal Child Support Guidelines. We will help you draft a parenting plan and support agreement that meets these legal standards.
What if we haven’t been separated for a full year yet?
In Canada, the most common “ground” for divorce is living separate and apart for one year. You can actually start the filing process before the year is up, but the court will not grant the final Divorce Judgment until the 12-month anniversary of your separation has passed.
What if we agree on almost everything, but have one small disagreement?
This is very common! You don’t have to give up on a peaceful negotiation and resolution. We often use a “mediation- like” approach to help couples resolve the division or those last few sticking points. Once you reach an agreement, we can then proceed with the uncontested filing.
